San Francisco's Health Care Security Ordinance


BOMA San Francisco Members -

In 2011, the San Francisco Board of Supervisors, working with a coalition of labor leaders, neighborhood activists, and businesses, amended the Health Care Security Ordinance.

The compromise closed a major loophole for Health Reimbursement Accounts (HRA), used by some businesses, on how HRAs can be administered and how businesses can structure surcharges to pay for employee healthcare. Before, consumers were being charged by a small minority of businesses to provide healthcare dollars to employees that were never fully accessed. Now, employees have protected reimbursement accounts that rollover while consumers have more protections. This compromise was reached without endangering jobs or economic growth in San Francisco.
